Corporate legal counsel surveyed in Fulbright & Jaworski's annual=20
study of in-house trends named electronic discovery the newest=20
wrinkle in the brow.=20

The 2005 litigation trends survey found that e-discovery was the No.=20
1 new litigation-related burden for companies with revenues of more=20
than $100 million. With e-mail and other digital data becoming more=20
prevalent as evidence in lawsuits, effective record keeping is=20
becoming a priority, and record retention policies and litigation=20
hold policies are gaining in prevalence.=20

It is the first time Fulbright put the e-discovery question out=20
there.=20

"We've had a lot of client interest in the subject in the last year,"=20
said Robert Owen, a Fulbright litigation partner and the leader of=20
the firm's records management and e-discovery practice group. "Over=20
the next five to 10 years, everyone involved -- courts, trial=20
lawyers, clients and vendors -- will struggle toward a solution that=20
addresses the problems we face today," he said.=20

Counsel at companies with revenue below $100 million named compliance=20
as a top worry, with many pointing to the requirements of the=20
Sarbanes-Oxley Act.=20

The survey found that at companies of all sizes, a quarter to a half=20
of all litigation concerned contract or labor-and-employment matters.=20

The Fulbright survey tapped 354 senior corporate counsel in the=20
United States and the United Kingdom, with about 40 percent at public=20
companies. Half of the respondents said they tracked legal spending --
reporting an average budget of $20 million, with about $8 million=20
spent on litigation matters.=20

The concern within corporate legal departments about e-discovery is=20
not surprising in light of recent media headlines. Earlier this year,=20
a Florida state jury ordered investment bank Morgan Stanley to cough=20
up $1.45 billion in a default judgment to financier Ronald Perelman=20
because it couldn't produce certain electronic documents. UBS=20
Warburg, Enron Corp. and WorldCom Inc. are just a few other cases=20
that brought disputes about computer evidence to the forefront.=20

Owen said corporate counsel are taking a closer look at policies=20
guiding record-keeping. According to the survey, about 80 percent of=20
U.S. companies have written retention policies. Of the companies=20
without written policies, 53 percent are considering adopting them.=20
Of the companies that have policies, 62 percent of respondents said=20
they've revised them in the past year, a high number, Owen said. "I=20
think it suggests people are taking a close look at these policies,"=20
he said. "I don't believe it a coincidence that in-house counsel=20
raised these concerns while simultaneously voicing their distress=20
over rising litigation costs -- in my view, the two are inseparably=20
linked."=20

It's not just hype, says Stephanie Mendelsohn, a partner on the=20
record management and litigation team at Reed Smith in Oakland. The=20
gargantuan volumes of documents subject to electronic discovery are=20
increasing litigation burdens and costs. "With electronic discovery=20
you can be talking about easily millions of pages of documents," she=20
said.=20

James Finberg, a partner at San Francisco's Lieff Cabraser Heimann &=20
Bernstein and president of the Bar Association of San Francisco, said=20
the relative burden of electronic discovery requests depends on the=20
type of information sought. Payroll and human resources data, for=20
example, can be much easier and less expensive to store and retrieve=20
in electronic form than in hard copy.=20

"I think it's over-dramatized," he said.
